Notice of Judicial Vacancy (New Seat) Skagit County Superior Court

Skagit County Superior Court is pleased that the legislature passed and Governor Ferguson signed a bill on March 25, 2026 increasing the number of judges in Skagit County from four to five.

The bill is set to take effect on June 11, 2026. Since this is a new position, Governor Ferguson will accept applications and ultimately appoint a 5th judge from the applicant pool. The governor’s office has posted a notice of judicial vacancy, with applications accepted through August 3, 2026. Once the governor has made an appointment, that individual will take office at the beginning of January 2027. The appointee will also need to file for election for the remainder of the term in May 2027.

Skagit County Superior Court Updated Language Access Plan

Skagit County Superior Court recently update its Language Access Plan (LAP). One new addition this year is a webpage dedicated to language access, which includes an online form for making interpreter requests. Skagit County Superior Court Appoints New Court Commissioner

Skagit County Superior Court is pleased to announce the appointment of Mark Kaiman as Superior Court Commissioner, effective January 8, 2026. Mark has been a practicing attorney for nearly twenty-five years and has served as the Judge of the Ferndale Municipal Court since 2019. Throughout his legal career, he has practiced in a broad range of areas, including family law; civil matters such as protection order hearings, general litigation, and unlawful detainer actions; juvenile court matters; and criminal matters. Mark is a graduate of Syracuse University College of Law and Washington State University.

Due to budget reductions and associated staffing changes, including the reduction of a full-time court commissioner position to part-time, this notice is effective immediately. The following modifications to the Skagit County Superior Court Weekly Schedule will begin on February 1, 2026:

Pro Se Domestic Motions

Pro Se Domestic Motions will now be heard on Thursdays at 9:00 a.m.. Currently scheduled matters will not be affected by this change.

Adoptions

There will no longer be a standing adoption calendar. Adoption matters must be special set by contacting superiorcourtadmin@co.skagit.wa.us

Friday Morning Civil Calendars

Unlawful Detainers will be calendared separately from other civil matters.

Members of the Bar,

This is a reminder that new local rules take effect on September 1st. A “changes only” document is attached to help you navigate the new rules.

Some highlights include:

An online ADA request form, that will be available for attorneys, litigants, jurors, and other members of the public to submit requests for accommodations;
The confirmation of dispositive motions and RALJ hearings has been increased from four court days to five court days, requiring confirmation on regular weeks by 4:00 p.m. the Thursday before the hearing;
A framework on how to present orders following an oral ruling;
Inclusion of a Spanish language version of “Attachment A” for Unlawful Detainer cases;
Increased compensation for arbitrators;
An allowance for LLLTs to review final orders in family law cases prior to their presentation for final entry;
Requirements for adult criminal and juvenile offender cases to be called on the record when certain timelines have passed and for attorneys to appear in person when their clients are also required to appear in person for court;
A new rule on when criminal motions may be brought with fewer than 9 court days’ notice, and;
Additional structure on the shelter care processes.

Finally, you might notice two new LCRs on Case Schedules. These rules will give the court flexibility to roll out caseflow management practices in certain case types, which will likely begin with minor guardianship cases. This process will involve stakeholders within each case type and is not yet underway. The bar’s liaison committees will be kept informed when this process begins.

This is just a high-level summary. Please see the attached changes. A complete version of the rules and the online ADA form will go live before September 1st.

Please see Skagit County Superior Court’s proposed local rules for 2025-2026. If adopted, these rules would take effect September 1, 2025.

One proposal of note is the timeframe to confirm dispositive motions on what is currently the 9:30 a.m. Thursday calendar. Due to challenges in scheduling trials for each upcoming week, the court proposes that the confirmation cut-off be moved one day from Friday at 4:00 p.m. to Thursday at 4:00 p.m.

There is also a newly proposed rule about case schedules. The court has been exploring caseflow management, which would involve court-issued case schedules either at filing or some other early stage of a case. Any roll-out of this process would happen gradually and would be specific to case types as it expands. We expect this would begin with minor guardianships and move to other types of cases, typically those involving children. Any of these efforts will include stakeholder input before adoption of final procedures.

Some rules related to criminal and juvenile procedures stem from proposals submitted from attorneys in those areas of practice. Two additions from the court are related to requests for continuances of criminal and juvenile offender proceedings and when people (including attorneys) need to appear in person for court instead of using the Zoom option.

Law Day - Reaffirm your Oath of Attorney

Law Day is coming up on May 1, 2025. The Skagit County legal community has a number of events throughout the day to commemorate the occasion, including the Law Day Legal Clinic and the annual Law Day Dinner.

In addition, the Skagit County Superior Court Bench would like to join with courts, judges, and attorneys from around the State, and invite you to reaffirm your oath of attorney in a brief ceremony to start the day on Law Day.

Update regarding Odyssey and JABS Outage

Message from Skagit County Superior Court Administration:

The statewide system outage affecting Odyssey and JABS access has not yet been resolved. The Court cannot access the court files or our calendars. Court calendars are still moving forward; however, the Bench is requesting assistance from the bar to ensure we can hear as many matters as possible.

For the Civil, Probate, Guardianship and Domestic dockets – please forward bench copies for all motions, note for calendar, declarations, responses, reply and supporting documents (including service documents) for hearings set on this week’s dockets. This will allow the judicial officers to review the motions in advance and conduct the hearings as scheduled. If bench copies are not provided, the judicial officers will not be aware of which matters are scheduled and will be unable to review the materials.

Please provide bench copies to the 2nd floor window in Court Administration as soon as possible.

If you are an attorney on the Minor Guardianship calendar or the opposing party is either not a member of the Skagit County Bar Association or is self-represented, please provide hard copies of all materials for the pending motion.

Statewide System Outage Affecting Skagit County Superior Court

There is a statewide system outage affecting Odyssey and JABS access. This will greatly affect the Court’s ability to manage its calendars as the Court does not have access to court files.

The Court requests the following:

Prepare a continuance for all matters that feasibly can be continued
Provide a physical judge’s copy for matters that must be heard
Limit filings to emergent matters only

Calendars will be moving slowly, and the Court appreciates everyone’s patience and cooperation as they work through this. It’s possible this outage will extend throughout the week. The Court will keep you updated on any changes.

Skagit County Superior Court appoints new Commissioner

The Skagit County Superior Court Judges are pleased to announce the appointment of Rebecca Carroll to serve as a Superior Court Commissioner. Commissioner Carroll will preside over ITA hearings and other court calendars as needed.

Ms. Carroll received her bachelor’s degree in Economics from the University of Washington and her Juris Doctor Law Degree from Seattle University. She has extensive private practice experience in the areas of guardianship/conservatorship, adoptions, civil contempt, and mental health cases. As a public defender, Ms. Carroll represented clients in dependency cases, juvenile matters, probation violations, drug court and civil contempt. Ms. Carroll previously served as a Pro Tem Commissioner for Skagit Superior Court. In her spare time, Ms. Carroll volunteers with Youthnet and is the CLE chair for the SCBA.

Court of Appeals, Div. I -- June 1 at Skagit Valley College

Public welcome as Court of Appeals, Div. I to hear cases June 1 at Skagit Valley College in Mount Vernon

The Washington State Court of Appeals, Division I, will hear oral arguments during a community visit to Skagit Valley College in Mount Vernon, WA on Thursday, June 1. The public is welcome to attend the oral arguments and to ask questions about the role and operations of the Court of Appeals during a Q&A session directly following argument.

The hearings will begin at 9:30 a.m. at the Tarro Theater located on the Mount Vernon campus of Skagit Valley College, 2405 East College Way, Mount Vernon, WA. They will be recorded and livestreamed by TVW.

“I am so looking forward to this great opportunity to have our court travel to the northern part of our region,” said Division I Chief Judge Lori K. Smith. “Having our arguments available for viewing via TVW has provided the opportunity for more people to see oral argument. But giving people, who might not be able to travel to Seattle, the opportunity to see oral argument live and ask questions afterwards is really exciting for us.”

Beginning at 9:30 a.m., Chief Judge Lori K. Smith, Acting Chief Judge Cecily C. Hazelrigg and Judge Bill A Bowman will hear arguments in the following cases:

835386 – State of Washington v. Frank Walton

835467 – State of Washington v. James Spitzer

842935 – Hartford, LLC, et ano. V. Tandem Services Corp., et ano.

844881 – Michael Conklin v. Boeing Co., et al.

Each argument will last approximately 20 minutes. Briefs and other filings in these cases can be found at Washington State Courts - Appellate and Trial Courts.

Division I of the Court of Appeals is located in Seattle, WA and hears appeals of cases from trial courts throughout the state, but primarily from King, Snohomish, Skagit, Whatcom, San Juan and Island Counties.

Division I is looking forward to bringing its work closer to the communities it serves. This event was originally scheduled for the spring of 2020, but was postponed indefinitely due to the COVID-19 pandemic. The experience and technological developments gained from working through the pandemic will enable Division I to continue with traveling court events within its region going forward.

Emergency Administrative Order 21-5

In light of the recent significant resurgence in COVID-19, including some exposures within the legal community, jury trials will be suspended until September 27, 2021. The judges do not take this decision lightly, but the current uptick in transmission is higher than at any prior point in the pandemic. This is a decision being made to protect the safety of everyone in the courtroom environment.

We would like to reiterate the court’s strong preference for appearances to be remote unless absolutely necessary, as detailed in Administrative Order 21-4. In recent months, the ex parte calendar and some others have become particularly crowded. Unless you or your client do not have access to technology allowing remote appearances, the appearance must take place over Zoom. We will be strictly enforcing these measures, including distancing. We also want to remind everyone that regardless of the hearing type, anyone with a potential exposure or symptoms of COVID-19 is ordered to not appear in the courthouse. Please make sure you are having those conversations with your clients prior to any expected court appearances.

Thank you for your patience with this ever-changing environment. We are hopeful that the community will return to safer levels of transmission so we can resume the important work of jury trials.

Glen C Hoff, Attorney

April 15, 1967 - June 04, 2021

After a brief and courageous battle with hepatorenal syndrome, Glen passed away the morning of June 4 at his Mount Vernon home. Close family members, and his two cats, attended Glen at the time of his passing.

In addition to his two cats, Maya and Silver, Glen is survived by his brother Michael G. Hoff and wife Joan, his sister Mildred T. Hoff, his brother Peter N. Hoff and wife Lisa, his niece Amy Vetter, and nephews Eddie Richardson, Justin Hoff, Andrew Hoff and Grant Hoff. Glen is preceded in death by his parents Dianne and Peter M. Hoff, and his brother David E. Hoff.

Glen put a lot of living into his 54 years. He was a prominent Skagit Valley trial attorney who grew up in Lynnwood, Washington. A 1985 graduate of Meadowdale High School (elected student body president),

he went on to earn an undergraduate degree in History from the University of Washington (while completing 2 years of Naval Reserve Officer Training), and a law degree from the University of Idaho College of Law. After an internship with the Asotin County Prosecutor’s office and a few years with a couple of Seattle law firms, Glen moved to Mount Vernon in the late 1990’s and began work as a criminal defense attorney with the Skagit County Public Defender’s office, where he rose to the position of Chief Deputy Public Defender. After 10 successful years with that office, he opened his own practice in Mount Vernon. In addition to his love for practicing law, Glen was an avid outdoorsman. He was particularly adept at all kinds of fishing. Besides local outings, Glen went on many destination fishing trips to eastern Washington, Idaho, Alaska and northern British Columbia, often accompanied by family members, close friends, or both. Glen will be remembered by a lot of people for a lot of things. He was widely admired and respected for his trial skills. Fishing and Glen just went together. He travelled extensively: Rome and Thailand were two more recent excursions, and he indulged himself and travelling companions with occasional trips to southern California (Santa Anita), Nevada (Reno/Las Vegas), and Hawaii. He was an excellent cook and enjoyed hosting dinner parties with friends. He was generous with his time, spending many volunteer hours in support of the Rotary and other community/charitable organizations, and providing free legal assistance for clients that could not afford it. The Swinomish tribe honored Glen with a “Blanket Ceremony” for volunteer legal work he performed on behalf of tribal members. He was active in local theater, most recently doing a turn as the high school principal in META’s production of “Stand and Deliver”. He made a name for himself on the local karaoke circuit with his rendition of Elvis’ “American Trilogy”. His wit was both sharp and disarming, and his charm was warm and genuine. He did not seek the spotlight, but he knew what to do when the light shone on him – he will be greatly missed.

Proposed Updates to Skagit County Superior Court Local Court Rules

We are posting the following message from Judge Laura Riquelme regarding the proposed updates to Skagit County Superior Court Local Court Rules.

Please see the Court’s proposed updates to the Local Court Rules. If adopted, these rules would take effect on September 1, 2021.

We are currently operating under emergency orders and rules, however that will not always be the case. Many of the Court’s proposed rule changes incorporate new procedures and technology that we have adopted over the last fourteen months. We are currently operating under emergency orders that supersede our standard local rules where they conflict, but we will not always be in a state of emergency. These changes will allow us to retain some of these new procedures, particularly related to remote appearances, beyond the pandemic. We are also adding two new parts. One creates local juvenile court rules related to dependency cases. The other part briefly covers language access and ADA accommodations.

The comment period to these proposed rules is through June 10, 2021. Comments received will be posted on the Court’s website. All comments should be forwarded to Lisa West at LisaW@co.skagit.wa.us

In addition to the proposals in these rules, the Court will be eliminating the forms appendices to the Local Court Rules. Any forms referred to in the Local Court Rules will be posted on the Court’s website before September 1^st. References to appendix items in the current rules will be changed to refer readers to that website.

Please see the below timelines:

May 17^th: deadline for rule proposals from other people or groups. We will post any submitted proposals on our website and disseminate according to GR 7.
June 10^th: deadline for comments on the Court’s proposed rules
June 17^th: deadline for comments on any rules proposed by the public

Skagit County Bar Association Celebrates Law Day by
Honoring Outstanding Community Contributors

Law Day, observed annually on May 1 for the last half-century, marks the nation’s commitment to the rule of law. Law Day also provides an opportunity to recognize the role of courts in democracy and the importance of jury service to maintaining the integrity of the courts.

Law Day programs are held across the country to help people better understand how law protects liberty and how the legal system strives to achieve justice. This year’s theme honors “Advancing the Rule of Law Now.”

In Skagit County, Law Day was celebrated by holding a virtual Law Day Legal Clinic, where 22 volunteer attorneys and 12 non-attorney volunteers provided legal services to over 75 clients. In addition, the Skagit County Bar Association, Skagit Legal Aid, and the Liberty Bell Award Committee invited individuals involved in law and justice and members of our community to attend a Law Day Virtual Cocktail Hour and Liberty Bell Award Ceremony. The event took place on Tuesday, May 4.^.

The event was a great success and included a variety of highlights. The Skagit County Bar Association President, Andy Schuh commenced the event by introducing special guests. Following this introduction, Skagit County Superior Court Judge Riquelme announced the Law Day Proclamation.

Swinomish Tribal Court Chief, Judge Pouley and his daughter, Jessica, discussed the Land Acknowledgement, which is a formal statement that recognizes and respects Indigenous Peoples as traditional stewards of this land and the enduring relationship that exists between Indigenous Peoples and their traditional territories.

Lucy Shainin, a junior from Anacortes High School, presented a compelling poetry reading for the attendees. Shainin was recently recognized as the Washington state champion in the national poetry reciting competition, she was the top candidate of 6,000 students from 28 participating schools across the state of Washington.

Gail Smith announced the formation of the new non-profit, Skagit Legal Aid, formally providing services as the Volunteer Lawyer Program.

Skagit Legal Aid awarded this year’s Community Partner of the Year Award to the dedicated team at the CCS Farmworker Center, Marta Martinez Olivera and Guillermina Bazante.

The Skagit County Bar Association and Skagit Legal Aid also awarded the Skagit County Pro Bono Service Award (formerly known as the Volunteer of the Year Award) to Leona Bratz. Bratz is Of Counsel to LeGros Buchanan & Paul, joining the firm in November 2015. She volunteers as a pro bono attorney with the Housing Justice Project in Skagit County and Snohomish County, and she is also on the Board of Directors of the Anacortes Family Center, a homeless shelter. Most recently she was a dedicated volunteer at SLA’s Law Day Clinic.

The Skagit County Bar Association presented the 2021 Liberty Bell Award to Flora Perez-Lucatero. The Liberty Bell Award has been awarded every year since 1968, recognizing an individual who has rendered outstanding service to his or her community. Perez Lucatero is Flora Perez-Lucatero’s name will be added to the plaque on display in the Skagit County Superior Courthouse, recognizing the previous Liberty Bell Award Recipients.

The keynote speaker was Chief Justice of the Washington Supreme Court, Debra L. Stephens, who inspired all the attendees to continue to provide service to our community. “Good things happen because we do good things,” said, Justice Stephens.

"I think the event was one of the best in recent memory, despite the need to host it via Zoom due to the ongoing pandemic. All of the award winners truly embody the spirit of Law Day and it was inspirational to hear their stories and Justice Stephens' story and to think about how real life overlaps with the privileges we enjoy in this country, as provided to us by our legal system," said Andy Schuh, Skagit County Bar Association President.

Skagit County Bar Association Launches Skagit Legal Aid

Skagit County Bar Association Launches Skagit Legal Aid

A new non-profit providing free legal services has been established by the Skagit County Bar Association’s Volunteer Lawyer Program.

The new non-profit is called Skagit Legal Aid and offers free legal assistance to eligible low-income Skagit County residents. The program is staffed by an Attorney/Program Manager and a Legal Assistant. Annually, Skagit County attorneys donate about 1,500 volunteer hours to nearly 500 people for more than $260,000 worth of legal services. Attorneys provide services in areas including eviction defense and other landlord-tenant disputes, family law issues, wills and powers of attorney, post-conviction support, and limited immigration assistance with Deferred Action for Childhood Arrivals (DACA) applications and renewals. Skagit Legal Aid hosts alternating biweekly legal clinics at the CCS Farmworker Center and East County Resource Center in Concrete in addition to regular virtual workshops. Staff also speak Spanish and can assist Spanish speaking clients. Translation services are available for other languages.

To date in 2021, the program has provided services to at least 134 clients.

Although Skagit Legal Aid officially opens its doors on June 1, 2021, its services have been provided to Skagit County for 35 years under the name of Skagit Volunteer Lawyer Program. Since 1986, the Skagit County Bar Association has partnered with Community Action to operate the free legal services program.

For over thirty-five years, the Skagit County Bar Association and Community Action worked together to provide program support. Community Action provided the programs integration with its anti-poverty mission and the bar association provided legal expertise and guidance of the program and maintained the program’s connection to the local legal community.

“We are very excited about this next step and the future of Skagit Legal Aid. We are looking forward to working with our many community partners in the effort to improve access to the courts and access to justice in Skagit County in a racially equitable manner,” said, Gail Smith, founder of the Volunteer Law Program.

One of the clients who has been served by the program, sent a message to the volunteering attorney, stating,

“Thank you so much! I do realize how much time and effort you're putting into this and I seriously can't convey to you just how much I appreciate your help. The last couple years have been an absolute nightmare not just for me but for my kids, my elderly parents, really my entire family. The stress has been so bad it's caused me to have some long term physical health issues. I finally feel like there is light at the end of the tunnel. So thank you, again, for bringing some peace of mind to me and a whole lot of other people that care about and depend on me.”

Skagit Legal Aid will be funded by grants and donations from the public. It will continue to work with and support its many wonderful community partners.

For legal assistance, call CLEAR at 1-888-201-1014, Monday through Friday, from 9:15 a.m. to 12:15 p.m. CLEAR is staffed by attorneys and paralegals who screen clients for eligibility and provides them with brief advice and services. The Skagit County Bar Association wants to congratulate Judge Thomas Verge and Judge Elizabeth Yost Neidzwski on their new positions at Skagit County Superior Court, as well as Dave Needy and David Svaren on their recent retirements. Judge Verge takes the position after serving as District Court judge since 2016 and, previous to that, as a commissioner in Whatcom County Superior Court. Judge Neidzwski was most recently a senior deputy defender at the Skagit County Public Defender’s Office, supervising the juvenile, mental health and parents' representation units.

Congratulations are also in order for Skagit County's newest District and Municipal Court Judge, Jenifer Howson, and the newest District and Municipal Court Commissioner, Paul Nielsen. Judge Howson was promoted from her commissioner position, which she has held since 2017, after practicing law in Skagit County for 20 years. Paul Nielsen previously served as senior deputy prosecutor for Skagit County.

The Executive Committee also wishes to extend its appreciation for members of the existing committees and solicit additional participants. All of the committees, with the exception of the VLP Steering Committee, are actively recruiting new members. Housing Justice Project

Most eviction actions are barred through March 31st, and additional eviction prevention funds are on the not-so-distant horizon. The state legislature is also hard at work on numerous bills to reform the unlawful detainer process to not only meet the needs resulting from the pandemic but also to create a sustainable legal process to keep tenants in rental properties and money in landlords’ pockets in the future. On January 20th, the VLP Manager testified in support of SB 5160 that, among other things, creates a right to counsel for tenants in unlawful detainers. Other proposals include just cause protections, repayment plans, limits to rent increases, and rental assistance programs funded by increased recording fees. Notwithstanding all of these developments, unlawful detainers are still being filed in Skagit County and tenants still need your assistance! In the coming weeks, our local expert David Henken will be providing a refresher trainer for volunteer attorneys about all of the changes to the unlawful detainer process over the past several years. Stay tuned for an invitation!

Concrete Clinics

Remote legal clinics are being held the 2nd and 4th Fridays of every month with appointment slots beginning at 9:00 am and ending at 3:00 pm. Prescreened clients visit the East County Resource Center to virtually meet with offsite volunteer attorneys. All types of legal experiences are wanted and needed!

REVAMPED - DACA Clinics

In years past, the VLP hosted successful clinics to help people file applications under the federal Deferred Action for Childhood Arrivals (DACA) program. The VLP is excited to relaunch these widely praised clinics in a virtual format. Immigration and non-immigration attorneys are needed! An informational meeting will be held at a later date.

NEW - Farmworker Clinics

The VLP is thrilled to announce the launch of a new legal clinic dedicated to serving farmworkers and their families! Beginning this winter, pro bono clients will be able to safely visit the CCS Farmworker Center to use VLP provided technology to meet with offsite volunteer attorneys concerning a variety of civil legal issues. Clinics will begin on certain Wednesdays with appointment slots beginning at noon and ending at 8:00pm. The VLP will provide free telephonic interpreting services if language barriers exist. The VLP particularly encourages any Spanish speaking attorneys to express their interest!

Retirement: Mike Winslow has retired, effective October 31, 2020. He obtained his JD from Southwestern University School of Law and was admitted to the bar in Washington State in 1983. Mike primarily practiced in the areas of business, construction, estate planning and real property from his office in Mount Vernon.

Retirement: Tom Moser has recently retired. He obtained his JD from Gonzaga, and was admitted to the bar in Washington State in 1977. He also earned a MPA from George Washington University and served in the U.S. Army, Infantry, from 1967 to 1969. Tom primarily practiced in the areas of real property, land use and personal injury from his office in Mount Vernon.

Stiles Law firm marks 70 years in Sedro-Woolley as Tim Lehr becomes partner in Stiles & Lehr Inc., P.S. On February 26, 1951, William A. Stiles Jr., was admitted into the Washington State Bar Association and he opened up a law office in his hometown Sedro-Woolley. He was later joined in the law practice by his son Brian L. Stiles in 1981, and his son Brock D. Stiles in 1986. William passed away in 2017 at the age of 93, and Brian is currently serving as a Skagit County Superior Court Judge. As Stiles Law enters its 70th year in Sedro-Woolley, Brock is pleased to announce that Timothy C. Lehr has become a partner in the law firm which will now become Stiles & Lehr Inc., P.S. The law firm will continue to provide legal services for personal injury, workers compensation, estate planning, probate, real estate, and landlord issues. Brock, Tim, and the entire staff at Stiles & Lehr Inc., P.S. are looking forward to continue the legacy started 70 years ago by William Stiles in providing outstanding legal services for many more years to come.

6. Thought You Should Know - Diverse Perspectives On Improving Justice In Big And Small Ways

Most unlawful detainer actions remain barred due to the state and federal moratoriums. However, attorneys practicing in this area should be aware of recent and potential future changes at both the county and state level in this area of law. The Skagit County Superior Court Local Rules related to unlawful detainer actions were amended on September 1, 2020; see specifically SCLCR 8. Additionally, SB 5160 has the potential for making substantial changes to the RLTA including, "addressing landlord-tenant relations by providing certain tenant protections during and after public health emergencies, providing for legal representation in eviction cases, and authorizing landlord access to state rental assistance programs."

Please bear in mind that this plan could change based on directives from either the Governor or our state Supreme Court which are inconsistent with this schedule.

I would like to thank all of the county personnel who have helped with every request we have made to protect the health of our court staff, attorneys, and litigants, particularly Public Health, Human Resources, Sheriff, Jail staff, Facilities, and Emergency Management. Skagit VLP Response to COVID19

In response to the current coronavirus restrictions, Skagit Volunteer Lawyer Program (a collaboration between the Skagit County Bar Association and Community Action of Skagit County) has shifted gears and is now taking referrals through the Northwest Justice Project’s C.L.E.A.R. hotline for a Virtual Legal Clinic to be held every Thursday afternoon from 1:00pm to 4:00pm (or by arrangement, on a case by case basis). The Clinic will consist of phone consultations only, and will be limited to advising and counseling clients unless the assigned attorney elects to provide additional services.

If you would like to help, please email Hollie Del Vecchio at holliedv@communityactionskagit.org. (Please include a list of practice areas in which you are interested in advising clients.)

Also take note that all in-person clinics have been cancelled until further notice. If you have volunteered for one of these clinics, please consider participating in the Virtual Legal Clinics instead. Mentoring may also be available, if you are interested in using this time to learn a new practice area!

Thank you in advance for any help you can provide during this unprecedented time, where clients’ need for legal services has skyrocketed at the same time that our ability to provide those services is hindered. We are excited about this new virtual structure, and are also exploring options to expand them to include teleconference options as the coronavirus situation subsided. So stay tuned!

Update from the Superior Court Presiding Judge to the BAR

To the members of SCBA and any attorneys practicing in Skagit County Superior Court:

In a very brief window of time, the entire State of Washington has had to adjust to being the epicenter of the COVID-19 outbreak in the United States. I can think of other forms of notoriety I would prefer. As matters have rapidly progressed, our grocery stores have been inundated by hordes of concerned people who seek to obtain supplies to see them through and our restaurants, bars, recreational facilities, and meeting places have been shuttered and our schools have been closed. The Courts have remained open.

The emergency conditions have caused extreme changes in our operations. Our earlier Orders have now been superceded by the Supreme Court’s Order (see attached). Barring emergent Civil matters and In Custody criminal matters, this Order leaves us a very narrow swath of cases we can hear. I expect to revise Skagit County Superior Court’s Order to reflect the terms of the Supreme Court’s Order and to give clarity on what we still can hear and how we will hear it. We will be in touch as soon as we can be with the new changes. In any event, all Emergency Orders are posted on our website.

The Judges and Superior Court Staff appreciate the understanding and cooperation the Skagit County Bar has shown in this Emergency.

Unfortunately, due to the current lack of staffing and volunteers in the Volunteer Lawyer Program, the Housing Justice Project will be temporarily suspended through April 24.

We will be sending a call out to all members to assist in the recruitment of a Program Manager candidate. We will be offering a $1,000 finder’s fee to anyone who finds a candidate who fills the position beyond three months.

Additionally, we need volunteers to assist with the HJP when it opens up again on May 1. Please let us know if you are available.

Additionally, we are monitoring whether or not the Law Day Clinic should continue as scheduled. We will know more in the week to come and will update everyone at that time.

Due to the recent cases of the COVID-19 virus in nearby counties, Skagit County Superior Court and the Skagit County Facilities Management Division are undertaking daily applications of disinfectant throughout the courthouse. Additionally, hand sanitizer dispensers are located on the first and second floors of the Courthouse. While we are using our best efforts to keep the Courthouse a safe environment, you are reminded to wash your hands regularly, avoid touching your face and stay home if you are sick.

Future Changes to Skagit County Superior Court's Calendar Schedule

The Judges will be moving from a weekly civil/criminal rotation to quarterly (every three months). The goal is to provide provide increased consistency and stability to the criminal and civil rotations. The civil rotation Judge will also take over the Juvenile Offender Calendar and the Protection Orders Calendar.

The Protection Orders calendar will be moved from Tuesday mornings to Tuesday afternoons (1:30 PM).

In an effort to reduce the amount of cases on the Friday morning Criminal Calendar, the Court is creating an out of custody Arraignment calendar on Tuesday mornings at 9:30 AM. Please docket any out of custody arraignments to this calendar beginning on April 7th.

Attached is a template of the new calendar with color highlights as to each schedule.

It is my pleasure to announce the appointment of Heather Shand to serve as Superior Court Commissioner. Heather received her B.A. in Sociology with a Minor in Society and Justice at the University of Washington in June, 1998 and subsequently received her Juris Doctor Law Degree from Gonzaga University School of Law in December, 2000. Additionally, Heather received her Masters of Law from the University of Washington specializing in Taxation in June, 2004. Heather has served in the capacity of Pro-Tem Judge for District Court as well as Pro-Tem Commissioner for Superior Court and has experience in family law including adoptions, guardianships, probates, business, taxation and estate planning. With Heather’s broad experience we anticipate a smooth transition with a tentative start date of September 30th.

Completed Will Clinics

The Volunteer Lawyer Program held Will Clinics since September of 2018 in four low-income senior housing facilities in the Mount Vernon and Burlington area. As a result, 40 seniors now have completed estate plans, typically consisting of a Will, Durable Power of Attorney for Finances, Durable Power of Attorney for Health Care and Health Care Directive.

Each of the clinics consisted of three separate sessions to help ensure that the clients had ample opportunities and time to understand estate planning concepts and to make careful decisions. The first session was a general educational presentation on basic estate planning. At the second session, an attorney met individually with each client to review the client’s information and objectives. At the final session, each client met individually with an attorney to review and then sign the documents.

Special recognition goes to Luigi Colombo for participating in two of the educational and review sessions as well as three of the signing sessions.

Funding for this and other VLP programs was provided by the Office of Civil Legal Aid and the Legal Foundation of Washington. In addition, the VLP received a technology grant from the local offices of Edward Jones to purchase the needed equipment for these clinics.

Wills Clinic Volunteer Opportunities!

The dates for the upcoming Will Clinics are now confirmed.

The Skagit Volunteer Lawyer Program is coordinating a series of information sessions and workshops to assist low-income elderly individuals by drafting powers of attorney, health care directives, community property agreements and wills. We are recruiting volunteer attorneys to assist at the workshops, which are scheduled from 1:00 p.m. until 5:00 p.m. on:

The VLP will provide all the necessary information and completed discussion drafts of the documents. Attorneys will review those prepared drafts with the participants, make any revisions, and then administer the execution of the documents. Mentorship will be available, so no prior experience in estate planning is required. This is a fantastic opportunity to develop skills and knowledge in estate planning, while assisting marginalized members of our community.

Please be advised that there will be no regularly scheduled calendars or trials during Judicial Spring Conference - except for ex parte at 1:15 p.m. and criminal rightings at 3:00 p.m. on Monday, Tuesday and Wednesday which will be heard by a District Court Judge. If you have an emergency order to be signed, please come to Court Administration. We will contact District Court and find out when a judge is available for you.

Skagit County Superior Court is happy to announce the appointment of Gwen Halliday to serve as Superior Court Commissioner. G. Brian Paxton is retiring after serving as Superior Court Commissioner since 2006.

Gwen brings 27 years of experience practicing law. She earned a bachelor's degree from Whitworth College and a law degree from the University of Washington Law School. She worked for the Attorney General's Office in Spokane before being appointed a deputy prosecutor for Skagit County. For the past five years, she has also served as a deputy prosecutor in San Juan County.

Gwen is an active member of the community. She served on the Board of Directors for Conway School District and Skagit Habitat for Humanity. She has also served in numerous roles with the Boy Scouts of America including District Chair and Activities Chair for the Mount Baker Council.

Gwen will begin her new role as Superior Court Commissioner on January 28, 2018.

SURVEY REGARDING MOVING FEDERAL CVB PROCEEDINGS VENUE TO MOUNT VERNON, WA

Dear Members of the Bar in Skagit County:

Magistrate Judge Paula McCandlis has asked our court to examine whether we can move Civil Violations Bureau (CVB) proceedings from the current location at the Bellingham Municipal Court to the new Skagit County Community Justice Center in Mount Vernon. Chief Judge Ricardo S. Martinez supports exploring this request.

CVB proceedings include pleas, sentencings, and non-jury trials, on petty offense and misdemeanor violations taking place in national parks or other federal enclaves. CVB defendants are scheduled to appear on a specific day and time, and are given the opportunity to consult with prosecutors and defense counsel in the courtroom. Most violations require only one court appearance.

We moved our CVB proceedings from the old Bellingham Federal Building to the Bellingham Municipal Court in September, 2016. Judge McCandlis has been conducting court there the first Tuesday of every month starting at 5 pm. We have court security officers screen all members of the public for weapons before they enter the courtroom.

We examined the defendant address data from the last three years and we noted virtually all of the defendants who received citations were from areas much further south than Bellingham. We suggest moving the proceedings will be more convenient for the defendants and others travelling for court.

The Skagit County Community Justice Center is a new facility near I-5. It is 27 miles south of Bellingham. It has a full size courtroom near the public entrance, a screening station for security officers, and plenty of parking. There is also a separate secure entrance for judges into chambers.

In order to actually move the proceedings, the request must first be approved by the Ninth Circuit Judicial Council. Then we have to have the approval of the Judicial Conference Committee on Court Administration and Case Management (CACM). Once we have the approvals of the Council and CACM, we need to formally request approval from the Judicial Conference of the U.S (JCUS). Once JCUS approves, the Judiciary will introduce legislation in Congress to add Mount Vernon as a place of holding court in Western Washington. Once the change is made to the statute to add Mount Vernon as a place of holding court, we can work on a contract with Skagit County to use the facility for our proceedings.

One important element in considering this request is input from the bar.

An emphasis on Juvenile and Family Law is desirable. Must be admitted to practice law in the state of Washington. Must be a citizen of the United States. Candidates will be expected to pass a criminal background check.

Additionally, candidates should possess strong interpersonal skills; the ability to build effective relationships with the legal community, the Court and staff; have excellent writing, legal research and analytical and computer skills.

WORKING CONDITIONS/REQUIREMENTS:

Work is performed primarily in an office or courtroom environment.

HAZARDS:

Those present in a normal office environment with occasional exposure to hostile persons and stressful situations.
