Firearm consequences are increasingly becoming an important consideration in criminal cases that may not initially appear to involve firearms. This CLE will focus on the intersection between Washington’s impaired-driving laws and firearm eligibility, along with significant recent developments in Washington firearms law.

Topics will include:

• When DUI and other impaired-driving offenses can result in firearm disqualification
• Washington’s unusually broad definition of a DUI “prior offense”
• The important distinction between a deferred prosecution and a conviction for firearm-eligibility purposes
• Firearm consequences associated with reduced DUI charges
• Washington State Patrol’s centralized SAFE firearms background-check system
• The Washington Supreme Court’s recent decision in McLellan v. Brown
• Restoration of firearm rights
• Washington’s new permit-to-purchase system, scheduled to take effect May 1, 2027
• Practical issues criminal practitioners should identify before resolving a case

Speaker: William “Bill” Kirk – Washington Gun Law

Bill Kirk is a former King County Prosecuting Attorney who practiced impaired-driving defense for nearly two decades and served as Dean of the National College for DUI Defense. During the pandemic, he founded the Washington Gun Law YouTube channel, which has grown to more than 500,000 subscribers and become a nationally recognized source of information regarding Second Amendment legislation and litigation.
